WHAT IS PHASE II
HWC MACT?
Phase II HWC MACT is an expansion in
the scope of the Hazardous Waste Combustor [HWC] MACT [Maximum
Achievable Control Technology] NESHAP [National Emission Standards for
Hazardous Air Pollutants], otherwise known as 40 CFR 63 Subpart EEE.
Phase II HWC MACT applies to boilers and hydrochloric acid production
furnaces (HAPFs) treating hazardous wastes. These units are
currently regulated under the Resource Conservation and Recovery Act
(RCRA) Boiler and Industrial Furnaces regulations (BIF, 40 CFR 266).
Affected facilities must come into full compliance within three years
from Phase II final promulgation. The proposed HWC MACT Phase II
rule was published in the Federal Register for comment on April 20,
2004. Final Rule was signed on September 14, 2005 and
published in the Federal Register on October 12, 2005.
